The 25-year-old was taken to Mascot police station and charged with domestic violence-related common assault, following an investigation into an alleged incident involving a 32-year-old woman.

Court documents, which list an address for Garside in the Melbourne suburb of Mooroolbark, allege the assault happened between 4pm and 7pm on March 1 in Bellevue Hill,in Sydney’s eastern suburbs.

Garside faced Downing Centre Local Court on Wednesday alongside high-profile barrister Sue Chrysanthou,SC,and lawyer Rebekah Giles for the first mention of his case.

Chrysanthou told magistrate Michael Barko they had “made substantial representations to the police in relation to material the police didn’t have access to at the time of charge”.

“In particular,a video of the incident in question which we say shows the complainant as the aggressor in the altercation[and] other material where she has made threats before going to police about making false complaints,” she said.

Chrysanthou said police were considering the representations and asked for a two-week adjournment,“if the matter is not withdrawn before that time”.

Prosecutor Adrian Walsh said it was not opposed.

Barko adjourned the case to June 7,when Garside is excused from appearing.
