Greens MLC David Shoebridge moved a motion in the chamber ordering the government to produce all documents relating to potential breaches of the COVID-19 restrictions by Deputy Premier John Barilaro and Mr Harwin.
However,Mr Shoebridge later amended the motion to remove any reference to Mr Harwin,after it emerged documents relating to Mr Harwin's fine could be subject to legal proceedings. Under NSW upper house rules,the house cannot force the government to produce documents relating to pending legal action.
It has since been confirmed that Mr Harwin is appealing the fine. Should the matter proceed to court,Mr Harwin will have a long wait for a hearing. Revenue NSW has advised it is not listing any new court matters until October 1.
Mr Harwin declined to comment when approached byThe Sydney Morning Herald.
He has previously insisted that he had not broken the law,and maintained he relocated to his holiday home before the public health orders were implemented on March 31.
Mr Harwin returned to Sydney twice after he relocated to the Pearl Beach property on March 15 for three weeks at the height of the coronavirus outbreak. On one return trip for the purposes of attending Parliament he was photographed shopping for clothes at Westfield Eastgardens shopping.
