"As this is unfolding,Bennett kicks Mokbel’s head three times with apparent force.
"Mokbel does not move from the time of Bennett's first punch and is unable to defend himself throughout the assault."
Teuira also punched Mokbel in the face,as other prisoners tried to intervene before guards arrived. Guards later found three"shivs"at the scene.
Prosecutors withdrew a charge of attempted murder when Bennett and Teuira offered to plead guilty earlier this month to intentionally causing serious injury in circumstances of gross violence and recklessly causing injury,the latter over an injury to inmate Steven Logan,31,who was stabbed in the side trying to help Mokbel.
Mokbel was unable to defend himself throughout the assault and was rushed to the Royal Melbourne Hospital,where he spent several days in a coma.
"It was very likely that without the swift response of emergency interventions,he would have died from the injuries sustained,"Ms Churchill’s summary says.
Mokbel was discharged from the Royal Melbourne after a week but spent the next seven weeks in rehabilitation at St Vincent’s Hospital,for cognitive impairments including difficulties holding a conversation,planning and problem solving.
By the time he returned to prison on April 9 he had shown signs of improvement.
The attack came one day after a newspaper reported Mokbel was an"enforcer"in prison and had disrupted an extortion racket involving Pacific Islander prisoners.
At the party,Mokbel handed Bennett a piece of paper and the younger man took it to his unit to read. When Bennett returned to the party he embraced Mokbel.
After Mokbel was attacked,a prison guard said he heard Bennett yell:"You’re not an enforcer,this is what you get for talking to the screws,you f--king dog."
Another guard said he heard Bennett yell:"You think you are an enforcer,well you are f--king not,you c---."
As the two attackers were handcuffed,guards heard Bennett tell Teuira:"Throw it away,cuz."Teuira then discarded the red-handled shiv.
Bennett then said"G-Fam"and"Well done,cuz,G-Fam."Investigators say Pacific Islander prisoners refer to their group as"G-Fam".
Teuira told Bennett:"Yeah,happy birthday,bro."
Teuira and Bennett remain in jail and are due to face the County Court in October.
Mokbel was jailed for 30 years in 2012 for drug trafficking but is challenging his convictions because of the role in his defence played by barrister-turned-police informer Nicola Gobbo.
