Icon alleges the damage was"caused by shortcomings in the design"by WSP,and that its construction was not to blame for the gaping cracks that led to the evacuation of residents on Christmas Eve last year.

In July,owners launched a class action against the state-owned Sydney Olympic Park Authority seeking millions of dollars in compensation. The authority is the owner of the land where the tower was constructed.

Sydney Olympic Park Authority subsequently dragged Icon and developer Ecove into the legal dispute.

Two months after the evacuation, a final report by engineers found the tower had multiple design and construction flaws,including concrete support beams that were prone to"bursting".

In the cross claim filed on Tuesday,Icon claims WSP failed to adequately design a"hob beam"for levels four,10 and 16 of the $170 million tower. It led to a"bursting or splitting tension"of the beams.

It alleged WSP"failed to design for bursting stresses"in the beam because it did not have enough steel reinforcement."Had WSP designed the hob beams to contain sufficient steel reinforcement ... the observed damage would not have occurred,"the documents state.

The severe cracking to the Opal,followed five months later bystructural damage to the Mascot Towers block in Sydney's south,sparked widespread concerns about new apartment buildings across the city.

Since August,aparliamentary inquiry has been scrutinising the construction industry,and last month it recommended the government set up a standalone building commission.

WSP declined to comment on Wednesday because the matter was before the court.

The case will return to the Supreme Court on Friday for a directions hearing.
