He appealed against the sentence and findings of guilt in the NSW District Court.
Jubelin argued five grounds of appeal, including that a warrant was in place when the first three recordings were made, which meant they were authorised, and magistrate Ross Hudson erred in failing to give himself two directions.
In a judgment on Friday,NSW District Court Judge Antony Townsden dismissed Jubelin's appeal and upheld the original $10,000 fine.
Judge Townsden said he did not accept on the balance of probabilities Jubelin made the recordings to protect his lawful interest,as Jubelin had maintained throughout the court case.
