But a magistrate on Thursday said the prosecution’s case was “not the strongest”,and granted Moran bail. He was briefly remanded again pending an appeal to the Supreme Court,but released Thursday night after prosecutors decided against the appeal.

Moran’s emotional and pregnant wife Samantha picked him up from Perth Airport,arriving after his flight landed on Friday.

He refused to make any comments to media,embracing his wife before heading to a police station.

Police alleged Moran suffocated his then-girlfriend in their caravan,before hiding her body under a pile of palm fronds at an abandoned sports ground near the caravan park where they were staying.

Strobel’s body was found five days later.

In court on Thursday,Moran’s barrister Tim Game SC was scathing of the police case against him.

He argued police had not put forward any evidence which progressed the case beyond what was heard during the 2007 coronial inquest.

Then-deputy state coroner Paul MacMahon had found there was insufficient evidence to refer the matter for prosecution.

Game said Moran had provided police with recent DNA samples and there was “nothing to suggest there is any new DNA that incriminates him”.

But prosecutor Kim Gourlie said it was a “potentially strong” circumstantial case,with new witness statements from people in Germany about the nature of Strobel and Moran’s relationship.

Moran will remain with family in Perth as he awaits trial.
